Điều khoản sử dụng WeDo

Áp dụng cho: web WeDo (wedofpt.com.vn), ứng dụng WeDo trên Android và trên iPhone.

Cảm ơn bạn đã dùng WeDo. Xin đọc kỹ văn bản này. Khi bạn đánh dấu ô đồng ý, bấm "Đồng ý và tiếp tục", hoặc tiếp tục dùng WeDo, bạn đồng ý với Điều khoản này. Nếu không đồng ý, xin đừng dùng WeDo.

Điều khoản này được công bố bằng tiếng Việt và tiếng Anh. Hai bản có hiệu lực như nhau. Nếu hai bản mâu thuẫn nhau, bản tiếng Việt được ưu tiên.

Điều quan trọng nhất WeDo KHÔNG KHOAN NHƯỢNG với nội dung phản cảm và với người dùng có hành vi lạm dụng, quấy rối hay bắt nạt người khác. Bạn có thể báo cáo tin nhắn và chặn người dùng ngay trong ứng dụng. Chúng tôi xem xét mọi báo cáo trong vòng 24 giờ. Nếu nội dung vi phạm, chúng tôi gỡ nội dung đó và loại người đăng khỏi WeDo.

1. Về WeDo và bên cung cấp

1.1. WeDo là dịch vụ giúp sinh viên làm việc nhóm. WeDo có không gian làm việc, dự án, công việc, trò chuyện dự án, tin nhắn riêng, bạn bè, cuộc họp, lịch, bảng đóng góp và một số tính năng dùng trí tuệ nhân tạo (AI).

1.2. Bên cung cấp WeDo là cá nhân Lê Hữu Đại. Cá nhân này phát triển và vận hành WeDo cùng nhóm WeDo Team, và chịu trách nhiệm với bạn theo Điều khoản này. Trong văn bản này, "WeDo", "chúng tôi" là bên cung cấp nói trên. "Bạn" là người dùng WeDo.

1.4. Điều khoản này đi cùng Chính sách quyền riêng tư tại https://wedofpt.com.vn/privacy.html. Chính sách quyền riêng tư nói rõ chúng tôi thu thập dữ liệu gì, dùng để làm gì, gửi cho ai và giữ trong bao lâu.

2. Người được dùng WeDo

2.1. Bạn phải đủ 18 tuổi trở lên. Khi tạo tài khoản hoặc bấm đồng ý với Điều khoản này, bạn xác nhận mình đủ 18 tuổi. Nếu biết một tài khoản thuộc về người chưa đủ 18 tuổi, chúng tôi sẽ xoá tài khoản đó.

2.2. Bạn không được dùng WeDo nếu chúng tôi đã chấm dứt tài khoản của bạn vì vi phạm, trừ khi chúng tôi cho phép bằng văn bản.

2.3. Nếu bạn dùng WeDo thay mặt một nhóm, câu lạc bộ hay tổ chức, bạn xác nhận mình có quyền làm việc đó.

3. Tài khoản

3.1. Bạn có thể tạo tài khoản bằng email và mật khẩu. Bạn cũng có thể đăng nhập bằng Google trên web WeDo, ứng dụng Android và ứng dụng iPhone. Riêng trên iPhone, bạn còn có thể đăng nhập bằng Apple; web và ứng dụng Android không có cách này.

3.2. Thông tin bạn cung cấp phải đúng. Hãy dùng tên mà nhóm của bạn nhận ra được. Không mạo danh người khác.

3.3. Hãy giữ an toàn mật khẩu WeDo, và cả tài khoản Google hay Apple ID bạn dùng để đăng nhập. Bạn chịu trách nhiệm về mọi hoạt động diễn ra dưới tài khoản của mình. Nếu thấy tài khoản bị dùng trái phép, hãy báo ngay cho chúng tôi qua email ở Điều 1.3.

3.4. Tài khoản là của riêng bạn. Không bán, cho mượn hay chuyển tài khoản cho người khác.

3.5. Trên web WeDo và ứng dụng iPhone, nếu bạn chưa từng đồng ý với Điều khoản này (ví dụ lần đầu vào WeDo bằng Google hoặc Apple), bạn phải xác nhận đủ 18 tuổi và đồng ý trước khi dùng. Nếu bạn chọn ẩn email khi đăng nhập bằng Apple, email của tài khoản là địa chỉ chuyển tiếp của Apple. Thư WeDo gửi tới địa chỉ đó có thể không tới bạn, nên hãy tiếp tục đăng nhập bằng Apple (xem mục 3.1 của Chính sách quyền riêng tư).

4. Nội dung của bạn

4.1. "Nội dung" là mọi thứ bạn đưa lên WeDo, ví dụ: tin nhắn, ảnh, tệp đính kèm, tên và mô tả công việc, bài nộp, thông tin cuộc họp, tên hiển thị, ảnh đại diện và góp ý gửi cho chúng tôi.

4.2. Bạn vẫn là chủ sở hữu Nội dung của mình. Bạn chịu trách nhiệm về Nội dung đó. Bạn phải có quyền đăng Nội dung, kể cả khi Nội dung có ảnh hay tài liệu của người khác.

4.3. Người xem được Nội dung của bạn:

4.4. Bạn cho phép chúng tôi lưu trữ, sao lưu, sao chép, xử lý, hiển thị và truyền Nội dung của bạn. Quyền này không độc quyền, miễn phí và áp dụng ở mọi nơi có máy chủ của chúng tôi hoặc của nhà cung cấp hạ tầng. Chúng tôi CHỈ dùng quyền này để:

  1. vận hành WeDo và cung cấp tính năng mà bạn hoặc nhóm của bạn dùng, ví dụ hiển thị tin nhắn cho thành viên dự án, gửi thông báo đẩy, và gửi dữ liệu cho nhà cung cấp AI khi tính năng AI được dùng (Điều 7);
  2. giữ an toàn cho WeDo và người dùng, gồm cả việc xem xét báo cáo vi phạm (Điều 6);
  3. làm theo yêu cầu của pháp luật.

Chúng tôi không bán Nội dung của bạn và không dùng Nội dung của bạn cho quảng cáo.

4.5. Quyền nói ở Điều 4.4 chấm dứt khi bạn xoá Nội dung hoặc xoá tài khoản. Chúng tôi có thể giữ lại một phần dữ liệu trong thời gian ghi ở Chính sách quyền riêng tư, hoặc lâu hơn nếu pháp luật yêu cầu hay nếu dữ liệu đó liên quan tới một báo cáo vi phạm.

4.6. Hãy tự lưu bản sao các tệp quan trọng. WeDo không thay thế cho nơi lưu trữ tài liệu lâu dài của bạn.

5. Quy tắc nội dung và hành vi — không khoan nhượng

5.1. WeDo là nơi để học và làm việc nhóm. Chúng tôi không khoan nhượng với nội dung phản cảm và người dùng lạm dụng. Một vi phạm nghiêm trọng là đủ để chúng tôi khoá tài khoản vĩnh viễn, không cần cảnh báo trước.

5.2. Bạn KHÔNG được đăng, gửi hay chia sẻ trên WeDo, kể cả trong tên hiển thị, ảnh đại diện, tệp và tin nhắn riêng:

  1. nội dung khiêu dâm, gợi dục; bất kỳ nội dung tình dục nào liên quan đến người chưa thành niên;
  2. nội dung bạo lực, đe doạ người khác, kích động bạo lực, cổ vũ tự làm hại bản thân hay tự tử;
  3. nội dung quấy rối, bắt nạt, lăng mạ, bôi nhọ hoặc làm nhục người khác;
  4. nội dung thù ghét hoặc phân biệt đối xử vì dân tộc, quê quán, tôn giáo, giới tính, xu hướng tính dục, khuyết tật, ngoại hình hay hoàn cảnh;
  5. thông tin cá nhân hoặc ảnh riêng tư của người khác khi họ chưa đồng ý;
  6. nội dung mạo danh người khác, tổ chức khác hoặc WeDo;
  7. nội dung lừa đảo, tin rác (spam), quảng cáo không được mời, lôi kéo đa cấp;
  8. mã độc, đường dẫn độc hại, hoặc nội dung nhằm lấy mật khẩu hay tài khoản của người khác;
  9. nội dung xâm phạm quyền tác giả, nhãn hiệu hay bí mật kinh doanh của người khác;
  10. nội dung về ma tuý, vũ khí, cờ bạc trái phép hay hàng hoá bị cấm;
  11. đề thi, bài làm hộ hay nội dung khác nhằm gian lận trong học tập, khi quy chế của trường bạn cấm việc đó;
  12. nội dung khác mà pháp luật Việt Nam cấm đăng tải hoặc chia sẻ.

5.3. Bạn KHÔNG được:

  1. gửi tin nhắn hay lời mời kết bạn liên tục cho người đã từ chối, đã phớt lờ hoặc đã chặn bạn;
  2. thêm người khác vào không gian làm việc hay dự án để quấy rối họ;
  3. dùng tài khoản khác để lách việc bị chặn hoặc bị khoá;
  4. báo cáo sai sự thật một cách cố ý để hại người khác;
  5. dùng tính năng AI của WeDo để tạo nội dung bị cấm ở Điều 5.2;
  6. dò tìm lỗ hổng, dùng công cụ tự động để thu thập dữ liệu, làm quá tải hệ thống, dịch ngược hay sửa đổi ứng dụng, trừ khi pháp luật cho phép;
  7. dùng WeDo vào mục đích trái pháp luật.

5.4. Chúng tôi không xem trước mọi Nội dung trước khi nó hiện ra. Chúng tôi dùng bộ lọc tự động thay những từ ngữ thô tục trong tin nhắn và tên hiển thị bằng dấu ***, và có thể gỡ bất kỳ Nội dung nào vi phạm Điều khoản này.

6. Báo cáo và chặn

6.1. Báo cáo. Khi thấy nội dung hay người dùng vi phạm Điều 5, hãy báo cho chúng tôi:

6.2. Chặn. Nhấn giữ tin nhắn của người đó, bấm nút ba chấm ở đầu cuộc trò chuyện riêng với họ, hoặc bấm nút ba chấm cạnh tên họ ở màn Bạn bè, rồi chọn "Chặn người này". Việc chặn có tác dụng ngay. Hai người không thể nhắn tin riêng hay kết bạn với nhau nữa, và không tìm thấy nhau khi tìm kiếm. Quan hệ bạn bè và lời mời kết bạn giữa hai người bị xoá. Trong ứng dụng, tin nhắn của người bị chặn bị ẩn với bạn, kể cả trong trò chuyện dự án chung. Người bị chặn không nhận được thông báo nào. Bạn có thể bỏ chặn trong Tài khoản → Người đã chặn.

6.3. Cam kết xử lý trong 24 giờ. Chúng tôi xem xét mọi báo cáo trong vòng 24 giờ kể từ khi nhận được. Nếu nội dung vi phạm Điều khoản này, chúng tôi:

  1. gỡ nội dung vi phạm; và
  2. loại người đăng khỏi WeDo bằng cách khoá hoặc chấm dứt tài khoản của họ.

Tài khoản bị khoá không đăng nhập được, và mọi phiên đăng nhập đang mở của tài khoản đó bị ngắt. Với vi phạm rất nghiêm trọng, như nội dung tình dục liên quan đến người chưa thành niên hay đe doạ tính mạng, chúng tôi khoá tài khoản ngay khi xác nhận, và báo cơ quan có thẩm quyền khi pháp luật yêu cầu.

6.4. Chúng tôi có thể cho người báo cáo biết kết quả xử lý. Chúng tôi không tiết lộ người báo cáo cho người bị báo cáo, trừ khi pháp luật buộc phải làm.

6.5. Nếu bạn hoặc người khác đang gặp nguy hiểm, hãy gọi ngay 113 (công an) hoặc 115 (cấp cứu). Đừng chờ phản hồi từ WeDo.

7. Tính năng AI

7.1. WeDo có tính năng dùng AI, ví dụ:

7.2. Để tạo kết quả, WeDo gửi dữ liệu cho nhà cung cấp AI bên thứ ba (Google Gemini, Microsoft Azure OpenAI hoặc OpenAI). Với đề xuất công việc, dữ liệu gồm: tin nhắn cần phân tích, tối đa 12 tin nhắn gần nhất của dự án kèm tên người gửi, tên dự án, và danh sách thành viên dự án (tên, vai trò). WeDo không gửi email hay số điện thoại cho AI. Với tóm tắt cuộc họp, dữ liệu gồm tên cuộc họp và bản ghi lời thoại. Điểm đánh giá và lời góp ý bạn gửi ở mục "Góp ý cho WeDo" có thể được gửi cho AI, không kèm tên hay email, để nhóm WeDo tổng hợp ý kiến. Chi tiết có trong Chính sách quyền riêng tư.

7.3. Trên ứng dụng iPhone và trên web, trước lần đầu bạn dùng đề xuất công việc bằng AI, WeDo hỏi bạn có đồng ý gửi dữ liệu như trên hay không. Nếu bạn không đồng ý, bạn vẫn dùng được các tính năng khác của WeDo. Bạn có thể tắt bất cứ lúc nào: "Cho phép dùng AI" trong tab Tài khoản trên iPhone, hoặc "Tắt AI (gợi ý công việc và WeDoAi)" trong Cài đặt → Hồ sơ cá nhân trên web. Ứng dụng Android bản hiện tại chưa hỏi trước: trưởng nhóm nhấn giữ một tin nhắn là dữ liệu được gửi cho AI ngay.

7.4. Kết quả của AI CHỈ LÀ GỢI Ý. AI có thể sai, thiếu, hiểu nhầm ý, chọn nhầm người hay nhầm hạn chót. Hãy kiểm tra và sửa trước khi tạo công việc hay dùng bản tóm tắt. Đừng dựa vào AI cho các quyết định quan trọng về điểm số, học tập, tài chính, sức khoẻ hay pháp lý. Bạn và nhóm của bạn chịu trách nhiệm về quyết định cuối cùng.

7.5. Tính năng AI có giới hạn số lần dùng mỗi tháng. Giới hạn này có thể thay đổi.

7.6. Đừng đưa vào tin nhắn những thông tin nhạy cảm mà bạn không muốn gửi cho nhà cung cấp AI.

8. Cuộc họp và dịch vụ của bên thứ ba

8.1. Phòng họp video chạy trên dịch vụ Daily.co và mở trong trình duyệt. Bất kỳ ai có đường dẫn phòng họp đều có thể vào phòng, nên đừng chia sẻ đường dẫn cho người ngoài nhóm.

8.2. Nếu nhóm bật chức năng ghi biên bản, lời nói trong cuộc họp được Daily.co chuyển thành văn bản. Bản ghi lời thoại này có thể được gửi cho AI để tóm tắt (Điều 7). Người bật chức năng này phải báo cho mọi người trong cuộc họp biết trước.

8.3. WeDo dùng một số dịch vụ của bên thứ ba, như đăng nhập bằng Google, Đăng nhập bằng Apple, dịch vụ gửi thông báo đẩy, dịch vụ lưu trữ và dịch vụ họp video. Khi dùng các dịch vụ này qua WeDo, bạn cũng phải tuân thủ điều khoản của họ. Chúng tôi không chịu trách nhiệm về nội dung hay hoạt động của dịch vụ bên thứ ba.

9. Dịch vụ, thay đổi và gián đoạn

9.1. Ứng dụng WeDo được tải miễn phí. Trên iPhone, gói Personal Pro và Team Growth được bán qua Apple In-App Purchase (xem Điều 9.5). Trên web WeDo, gói được thanh toán qua cổng payOS. Ứng dụng Android không bán hàng hoá hay dịch vụ nào bên trong ứng dụng.

9.2. Một số tính năng, như tạo dự án hay thêm thành viên, hiện chỉ có trên web WeDo.

9.3. Chúng tôi cố gắng giữ WeDo chạy ổn định, nhưng không bảo đảm WeDo luôn chạy liên tục, không lỗi hay không mất dữ liệu. WeDo có thể tạm dừng để bảo trì, sửa lỗi hoặc vì sự cố ngoài tầm kiểm soát của chúng tôi. Chúng tôi có thể thêm, sửa hoặc bỏ tính năng. Nếu ngừng toàn bộ dịch vụ, chúng tôi sẽ báo trước ít nhất 30 ngày qua ứng dụng hoặc email.

9.4. Để dùng tiếp WeDo, đôi khi bạn cần cập nhật ứng dụng lên phiên bản mới.

9.5. Thuê bao qua App Store. Trên ứng dụng iPhone, bạn có thể mua gói Personal Pro hoặc Team Growth bằng thuê bao tự động gia hạn qua App Store. Khoản tiền được tính vào Apple ID của bạn khi bạn xác nhận mua. Thuê bao tự động gia hạn theo từng kỳ (tháng hoặc năm) bằng đúng giá đã hiển thị lúc mua (Apple sẽ thông báo và xin bạn đồng ý trước khi tăng giá), trừ khi bạn tắt gia hạn ít nhất 24 giờ trước khi kỳ hiện tại kết thúc. Bạn quản lý và huỷ thuê bao trong Cài đặt → [tên của bạn] → Thuê bao trên iPhone. Việc hoàn tiền cho khoản mua qua App Store do Apple xử lý theo chính sách của Apple; WeDo không hoàn tiền thay Apple. Gói mua qua App Store dùng được trên cả ứng dụng và web WeDo của cùng tài khoản.

10. Quyền sở hữu trí tuệ của WeDo

10.1. Tên WeDo, logo, giao diện, mã nguồn và tài liệu của WeDo thuộc về chúng tôi hoặc bên cấp phép cho chúng tôi. Điều khoản này không chuyển các quyền đó cho bạn.

10.2. Chúng tôi cho bạn quyền dùng ứng dụng WeDo cho mục đích cá nhân, theo Điều khoản này. Quyền này có giới hạn, không độc quyền, không chuyển nhượng được và có thể bị thu hồi. Nếu bạn tải WeDo từ App Store, phạm vi quyền còn tuân theo Điều 16.

10.3. Bạn không được sao chép, sửa đổi, phân phối, bán hay cho thuê ứng dụng, và không được dịch ngược mã nguồn, trừ khi pháp luật cho phép.

10.4. Nếu bạn gửi góp ý hay ý tưởng cho WeDo, chúng tôi được dùng góp ý đó để cải thiện WeDo mà không phải trả phí hay có nghĩa vụ nào với bạn.

10.5. Nếu bạn cho rằng Nội dung trên WeDo xâm phạm quyền của bạn, hãy gửi email tới wedosupport6886@gmail.com. Chúng tôi sẽ xử lý như một báo cáo theo Điều 6.

11. Chấm dứt

11.1. Bạn có thể ngừng dùng WeDo bất cứ lúc nào. Để xoá tài khoản, vào Tài khoản → Xoá tài khoản trong ứng dụng, hoặc làm theo hướng dẫn tại https://wedofpt.com.vn/xoa-tai-khoan.html. Nếu bạn là chủ một không gian làm việc còn thành viên khác, bạn cần chuyển quyền chủ trước khi xoá. Nếu bạn từng đăng nhập bằng Apple, việc xoá trong ứng dụng cũng thu hồi Đăng nhập bằng Apple của WeDo. Dữ liệu sau khi xoá được xử lý theo Chính sách quyền riêng tư.

11.2. Chúng tôi có thể tạm khoá hoặc chấm dứt tài khoản của bạn, và gỡ Nội dung của bạn, nếu:

  1. bạn vi phạm Điều khoản này, đặc biệt là Điều 5;
  2. cơ quan nhà nước có thẩm quyền yêu cầu;
  3. việc đó cần để bảo vệ người dùng khác, WeDo hoặc bên thứ ba.

Với vi phạm nghiêm trọng, chúng tôi làm ngay mà không báo trước. Với vi phạm nhẹ, chúng tôi có thể nhắc nhở trước.

11.3. Người bị chấm dứt tài khoản vì vi phạm không được tạo tài khoản mới.

11.4. Nếu bạn cho rằng chúng tôi xử lý nhầm, hãy gửi email tới wedosupport6886@gmail.com trong vòng 30 ngày kể từ khi bị khoá. Chúng tôi sẽ xem xét lại và trả lời bạn.

11.5. Các Điều 4.5, 10, 12, 13, 14, 15 và 16 vẫn còn hiệu lực sau khi tài khoản bị chấm dứt.

12. Không bảo đảm

12.1. Trong phạm vi pháp luật cho phép, WeDo được cung cấp "như hiện có" và "khi sẵn có". Chúng tôi không bảo đảm WeDo đáp ứng mọi nhu cầu của bạn, không bảo đảm kết quả của AI là đúng, và không bảo đảm Nội dung do người dùng khác đăng là đúng hay phù hợp.

12.2. Chúng tôi không chịu trách nhiệm về Nội dung do người dùng khác đăng. Chúng tôi vẫn xử lý Nội dung vi phạm khi được báo cáo, theo Điều 6.

12.3. Điều này không làm mất các quyền mà pháp luật Việt Nam về bảo vệ quyền lợi người tiêu dùng dành cho bạn.

13. Giới hạn trách nhiệm

13.1. Trong phạm vi pháp luật cho phép, chúng tôi không chịu trách nhiệm về thiệt hại gián tiếp, như mất lợi nhuận, mất dữ liệu, mất cơ hội học tập, hay ảnh hưởng tới điểm số, phát sinh từ việc bạn dùng hoặc không dùng được WeDo.

13.2. Trong phạm vi pháp luật cho phép, tổng trách nhiệm của chúng tôi đối với bạn không vượt quá số lớn hơn giữa: (a) số tiền bạn đã trả cho WeDo trong 12 tháng trước sự việc; và (b) 500.000 đồng.

13.3. Điều 13 không loại trừ trách nhiệm của chúng tôi trong những trường hợp pháp luật không cho phép loại trừ, như lỗi cố ý của chúng tôi.

14. Trách nhiệm của bạn khi vi phạm

Nếu bạn vi phạm Điều khoản này hoặc pháp luật và việc đó gây thiệt hại cho chúng tôi hay cho người khác, bạn chịu trách nhiệm bồi thường theo quy định của pháp luật Việt Nam.

15. Luật áp dụng và giải quyết tranh chấp

15.1. Điều khoản này được điều chỉnh bởi pháp luật Việt Nam.

15.2. Nếu có tranh chấp, trước hết hãy liên hệ chúng tôi qua email wedosupport6886@gmail.com để thương lượng. Nếu sau 30 ngày không thương lượng được, mỗi bên có quyền đưa tranh chấp ra Toà án nhân dân có thẩm quyền của Việt Nam.

16. Điều khoản riêng khi bạn tải WeDo từ App Store của Apple

Điều 16 áp dụng khi bạn tải ứng dụng WeDo từ App Store. Với ứng dụng tải từ App Store, Thoả thuận cấp phép người dùng cuối chuẩn của Apple (Licensed Application End User License Agreement, tại https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) cũng áp dụng giữa bạn và bên cung cấp WeDo, cùng với Điều khoản này. Nếu Điều 16 khác với phần còn lại của Điều khoản này, Điều 16 được ưu tiên đối với ứng dụng tải từ App Store.

16.1. Ghi nhận. Điều khoản này là thoả thuận giữa bạn và bên cung cấp WeDo nêu ở Điều 1.2, không phải với Apple Inc. ("Apple"). Bên cung cấp WeDo, không phải Apple, chịu trách nhiệm duy nhất về ứng dụng WeDo và nội dung của ứng dụng. Điều khoản này không đặt ra quy tắc sử dụng nào trái với Điều khoản và Điều kiện của Dịch vụ Truyền thông Apple (Apple Media Services Terms and Conditions) tại thời điểm Điều khoản này có hiệu lực.

16.2. Phạm vi giấy phép. Bạn được cấp giấy phép không được chuyển nhượng để dùng ứng dụng WeDo trên các thiết bị mang thương hiệu Apple mà bạn sở hữu hoặc kiểm soát, theo Quy tắc sử dụng (Usage Rules) trong Điều khoản và Điều kiện của Dịch vụ Truyền thông Apple. Ngoại lệ: các tài khoản khác liên kết với người mua qua tính năng Chia sẻ trong gia đình (Family Sharing) hoặc mua số lượng lớn (volume purchasing) cũng được truy cập và dùng ứng dụng.

16.3. Bảo trì và hỗ trợ. Bên cung cấp WeDo chịu trách nhiệm duy nhất về việc bảo trì và hỗ trợ ứng dụng, như nêu trong Điều khoản này hoặc theo quy định của pháp luật. Bạn và bên cung cấp WeDo cùng ghi nhận rằng Apple không có bất kỳ nghĩa vụ nào phải cung cấp dịch vụ bảo trì hay hỗ trợ cho ứng dụng.

16.4. Bảo đảm. Bên cung cấp WeDo chịu trách nhiệm duy nhất về mọi bảo đảm đối với ứng dụng, dù được nêu rõ hay do pháp luật quy định, trong phạm vi không được miễn trừ hợp lệ. Nếu ứng dụng không đúng với một bảo đảm áp dụng, bạn có thể báo cho Apple, và Apple sẽ hoàn lại giá mua ứng dụng cho bạn (nếu có; ứng dụng WeDo tải miễn phí). Trong phạm vi tối đa pháp luật cho phép, Apple không có nghĩa vụ bảo đảm nào khác đối với ứng dụng. Mọi khiếu nại, tổn thất, trách nhiệm, thiệt hại, chi phí khác do ứng dụng không đúng với bảo đảm thuộc trách nhiệm duy nhất của bên cung cấp WeDo.

16.5. Khiếu nại về sản phẩm. Bên cung cấp WeDo, không phải Apple, chịu trách nhiệm giải quyết mọi khiếu nại của bạn hoặc của bên thứ ba liên quan đến ứng dụng, hoặc đến việc bạn sở hữu và dùng ứng dụng, gồm nhưng không giới hạn: (i) khiếu nại về trách nhiệm sản phẩm; (ii) khiếu nại rằng ứng dụng không tuân thủ yêu cầu pháp lý hoặc quy định hiện hành; và (iii) khiếu nại phát sinh theo pháp luật về bảo vệ người tiêu dùng, quyền riêng tư hoặc pháp luật tương tự. Điều khoản này không giới hạn trách nhiệm của bên cung cấp WeDo đối với bạn quá mức mà pháp luật cho phép.

16.6. Quyền sở hữu trí tuệ. Nếu bên thứ ba khiếu nại rằng ứng dụng, hoặc việc bạn sở hữu và dùng ứng dụng, xâm phạm quyền sở hữu trí tuệ của họ, thì bên cung cấp WeDo, không phải Apple, chịu trách nhiệm duy nhất về việc điều tra, bảo vệ, dàn xếp và giải quyết khiếu nại đó.

16.7. Tuân thủ pháp luật. Bạn cam đoan rằng: (i) bạn không ở quốc gia bị Chính phủ Hoa Kỳ cấm vận, hoặc bị Chính phủ Hoa Kỳ xếp vào nhóm quốc gia "hỗ trợ khủng bố"; và (ii) bạn không có tên trong bất kỳ danh sách các bên bị cấm hoặc bị hạn chế nào của Chính phủ Hoa Kỳ.

16.8. Tên và thông tin liên hệ của nhà phát triển. Mọi câu hỏi, khiếu nại hoặc yêu cầu về ứng dụng xin gửi tới: Lê Hữu Đại, qua email wedosupport6886@gmail.com.

16.9. Điều khoản của bên thứ ba. Khi dùng ứng dụng, bạn phải tuân thủ các thoả thuận đang áp dụng giữa bạn và bên thứ ba, ví dụ hợp đồng dịch vụ dữ liệu di động với nhà mạng của bạn.

16.10. Bên thứ ba thụ hưởng. Bạn và bên cung cấp WeDo ghi nhận và đồng ý rằng Apple và các công ty con của Apple là bên thứ ba thụ hưởng của Điều khoản này. Khi bạn chấp nhận Điều khoản này, Apple có quyền (và được coi là đã chấp nhận quyền) thực thi Điều khoản này đối với bạn với tư cách bên thứ ba thụ hưởng.

17. Thay đổi điều khoản

17.1. Chúng tôi có thể sửa Điều khoản này. Mỗi lần sửa, chúng tôi cập nhật ngày ở đầu trang.

17.2. Với thay đổi lớn, chúng tôi báo trong ứng dụng hoặc qua email trước khi áp dụng, và có thể đề nghị bạn đồng ý lại. Nếu bạn không đồng ý, bạn có thể ngừng dùng và xoá tài khoản theo Điều 11.1.

17.3. Với thay đổi nhỏ, như sửa câu chữ hay sửa thông tin liên hệ, việc bạn tiếp tục dùng WeDo nghĩa là bạn đồng ý với bản mới.

18. Điều khoản chung

18.1. Điều khoản này cùng với Chính sách quyền riêng tư là toàn bộ thoả thuận giữa bạn và chúng tôi về việc dùng WeDo, bên cạnh thoả thuận cấp phép của Apple nêu ở Điều 16 khi bạn tải ứng dụng từ App Store.

18.2. Nếu một phần của Điều khoản này bị coi là vô hiệu, các phần còn lại vẫn có hiệu lực.

18.3. Việc chúng tôi chưa thực thi một quyền nào đó không có nghĩa là chúng tôi từ bỏ quyền đó.

18.4. Chúng tôi có thể chuyển Điều khoản này cho một tổ chức tiếp quản việc vận hành WeDo, ví dụ một công ty do chúng tôi thành lập. Khi đó, chúng tôi sẽ báo cho bạn. Bạn không được chuyển quyền và nghĩa vụ của mình theo Điều khoản này cho người khác.

18.5. Ngôn ngữ. Điều khoản này được công bố bằng tiếng Việt và tiếng Anh, và hai bản có hiệu lực như nhau. Nếu hai bản mâu thuẫn nhau, bản tiếng Việt được ưu tiên. Nếu có bản dịch sang ngôn ngữ khác, bản tiếng Việt cũng được ưu tiên.

WeDo Terms of Use

Applies to: the WeDo website (wedofpt.com.vn), and the WeDo apps on Android and on iPhone.

Thank you for using WeDo. Please read this document carefully. When you tick the consent box, tap "Agree and continue", or keep using WeDo, you agree to these Terms. If you do not agree, please do not use WeDo.

These Terms are published in Vietnamese and in English. Both versions have equal effect. If the two versions conflict, the Vietnamese version prevails.

The most important rule WeDo has ZERO TOLERANCE for objectionable content and for users who abuse, harass or bully others. You can report messages and block users right inside the app. We review every report within 24 hours. If the content violates these Terms, we remove it and remove the user who posted it from WeDo.

1. About WeDo and the provider

1.1. WeDo is a service that helps students work in teams. WeDo offers workspaces, projects, tasks, project chat, direct messages, friends, meetings, a calendar, a contribution report, and some features that use artificial intelligence (AI).

1.2. The provider of WeDo is the individual Lê Hữu Đại. This individual develops and runs WeDo together with the WeDo Team, and is responsible to you under these Terms. In this document, "WeDo" and "we" mean that provider. "You" means the user of WeDo.

1.4. These Terms go together with the Privacy Policy at https://wedofpt.com.vn/privacy.html. The Privacy Policy explains what data we collect, what we use it for, who we send it to and how long we keep it.

2. Who may use WeDo

2.1. You must be at least 18 years old. When you create an account or agree to these Terms, you confirm that you are at least 18. If we learn that an account belongs to someone under 18, we will delete that account.

2.2. You may not use WeDo if we have terminated your account for a violation, unless we allow it in writing.

2.3. If you use WeDo on behalf of a team, club or organization, you confirm that you have the authority to do so.

3. Your account

3.1. You can create an account with an email address and a password. You can also sign in with Google on the WeDo website, the Android app and the iPhone app. On iPhone only, you can also sign in with Apple; the website and the Android app do not offer this.

3.2. The information you provide must be accurate. Use a name your team will recognize. Do not impersonate anyone else.

3.3. Keep your WeDo password safe, and also the Google account or Apple ID you use to sign in. You are responsible for all activity under your account. If you see unauthorized use of your account, tell us right away by email at the address in Article 1.3.

3.4. Your account is yours alone. Do not sell, lend or transfer it to anyone else.

3.5. On the WeDo website and the iPhone app, if you have never agreed to these Terms (for example, the first time you enter WeDo with Google or Apple), you must confirm that you are at least 18 and agree before you use WeDo. If you choose to hide your email when you sign in with Apple, your account email is an Apple relay address. Email that WeDo sends to that address may not reach you, so keep signing in with Apple (see section 3.1 of the Privacy Policy).

4. Your content

4.1. "Content" means everything you put on WeDo, for example: messages, photos, attachments, task names and descriptions, submissions, meeting information, display name, avatar, and feedback you send us.

4.2. You remain the owner of your Content. You are responsible for it. You must have the right to post the Content, including when it contains other people's photos or documents.

4.3. Who can see your Content:

4.4. You allow us to store, back up, copy, process, display and transmit your Content. This right is non-exclusive, royalty-free, and applies wherever our servers or our infrastructure providers' servers are located. We use this right ONLY to:

  1. run WeDo and provide the features that you or your team use, for example showing messages to project members, sending push notifications, and sending data to AI providers when an AI feature is used (Article 7);
  2. keep WeDo and its users safe, including reviewing violation reports (Article 6);
  3. comply with legal requirements.

We do not sell your Content and we do not use your Content for advertising.

4.5. The right described in Article 4.4 ends when you delete the Content or delete your account. We may keep some data for the period stated in the Privacy Policy, or longer if the law requires it or if the data relates to a violation report.

4.6. Keep your own copies of important files. WeDo is not a substitute for your long-term document storage.

5. Content and conduct rules — zero tolerance

5.1. WeDo is a place to study and work in teams. We have zero tolerance for objectionable content and abusive users. A single serious violation is enough for us to suspend an account permanently, without prior warning.

5.2. You must NOT post, send or share on WeDo, including in display names, avatars, files and direct messages:

  1. pornographic or sexually suggestive content; any sexual content involving minors;
  2. violent content, threats against others, incitement to violence, or content encouraging self-harm or suicide;
  3. content that harasses, bullies, insults, defames or humiliates others;
  4. hateful or discriminatory content based on ethnicity, place of origin, religion, gender, sexual orientation, disability, appearance or circumstances;
  5. other people's personal information or private photos without their consent;
  6. content that impersonates another person, another organization or WeDo;
  7. fraudulent content, spam, unsolicited advertising, or pyramid-scheme recruitment;
  8. malware, malicious links, or content designed to obtain other people's passwords or accounts;
  9. content that infringes others' copyright, trademarks or trade secrets;
  10. content about drugs, weapons, illegal gambling or prohibited goods;
  11. exam papers, ghost-written assignments or other content intended to cheat in your studies, where your school's regulations prohibit it;
  12. any other content that Vietnamese law prohibits from being posted or shared.

5.3. You must NOT:

  1. repeatedly send messages or friend requests to someone who has declined, ignored or blocked you;
  2. add others to a workspace or project in order to harass them;
  3. use another account to get around a block or a suspension;
  4. knowingly file false reports in order to harm others;
  5. use WeDo's AI features to create content that is prohibited under Article 5.2;
  6. probe for vulnerabilities, use automated tools to harvest data, overload the system, or reverse engineer or modify the app, unless the law allows it;
  7. use WeDo for any unlawful purpose.

5.4. We do not pre-screen all Content before it appears. We use an automatic filter that replaces profane words in messages and display names with ***, and we may remove any Content that violates these Terms.

6. Reporting and blocking

6.1. Reporting. When you see content or a user that violates Article 5, tell us:

6.2. Blocking. Press and hold that person's message, tap the three-dot button at the top of your direct conversation with them, or tap the three-dot button next to their name on the Friends screen, then choose "Block this person" ("Chặn người này"). Blocking takes effect immediately. The two of you can no longer send each other direct messages or friend requests, and cannot find each other in search. Any friendship and friend requests between you are removed. In the app, the blocked person's messages are hidden from you, including in shared project chats. The blocked person receives no notification. You can unblock in Account → Blocked users ("Tài khoản → Người đã chặn").

6.3. Our commitment to act within 24 hours. We review every report within 24 hours of receiving it. If the content violates these Terms, we:

  1. remove the violating content; and
  2. remove the user who posted it from WeDo by suspending or terminating their account.

A suspended account cannot sign in, and all of its open sessions are ended. For very serious violations, such as sexual content involving minors or threats to life, we suspend the account as soon as we confirm the violation, and we notify the competent authorities when the law requires.

6.4. We may tell the reporter the outcome. We do not disclose the reporter's identity to the reported person, unless the law requires us to.

6.5. If you or someone else is in danger, call 113 (police) or 115 (emergency medical services) in Vietnam immediately. Do not wait for a response from WeDo.

7. AI features

7.1. WeDo has features that use AI, for example:

7.2. To produce results, WeDo sends data to a third-party AI provider (Google Gemini, Microsoft Azure OpenAI or OpenAI). For task suggestions, the data consists of: the message to be analyzed, up to the 12 most recent messages of the project with the senders' names, the project name, and the list of project members (names, roles). WeDo does not send emails or phone numbers to AI. For meeting summaries, the data consists of the meeting name and the transcript. The rating and comments you submit in "Send feedback to WeDo" may be sent to AI, without name or email, so that the WeDo team can summarize opinions. Details are in the Privacy Policy.

7.3. On the iPhone app and on the website, before you first use AI task suggestions, WeDo asks whether you agree to send data as described above. If you do not agree, you can still use the other features of WeDo. You can turn it off at any time: "Allow AI" ("Cho phép dùng AI") in the Account tab on iPhone, or "Turn off AI (task suggestions and WeDoAi)" ("Tắt AI (gợi ý công việc và WeDoAi)") in Settings → Profile on the website. The current Android app does not ask first: when a leader presses and holds a message, the data is sent to AI right away.

7.4. AI output is ONLY A SUGGESTION. AI can be wrong or incomplete, can misunderstand meaning, and can pick the wrong person or the wrong deadline. Check and correct it before you create a task or rely on a summary. Do not rely on AI for important decisions about grades, studies, finances, health or legal matters. You and your team are responsible for the final decision.

7.5. AI features have a monthly usage limit. This limit may change.

7.6. Do not put sensitive information into messages if you do not want it sent to an AI provider.

8. Meetings and third-party services

8.1. Video meeting rooms run on the Daily.co service and open in a browser. Anyone who has the meeting room link can join the room, so do not share the link with people outside your team.

8.2. If your team turns on the meeting-notes function, speech in the meeting is converted to text by Daily.co. This transcript may be sent to AI for summarizing (Article 7). The person who turns this function on must tell everyone in the meeting beforehand.

8.3. WeDo uses some third-party services, such as Sign in with Google, Sign in with Apple, push notification services, storage services and video meeting services. When you use these services through WeDo, you must also comply with their terms. We are not responsible for the content or operation of third-party services.

9. The service, changes and interruptions

9.1. The WeDo app is free to download. On iPhone, the Personal Pro and Team Growth plans are sold through Apple In-App Purchase (see Article 9.5). On the WeDo website, plans are paid for through the payOS payment gateway. The Android app does not sell any goods or services inside the app.

9.2. Some features, such as creating projects or adding members, are currently available only on the WeDo website.

9.3. We try to keep WeDo running reliably, but we do not guarantee that WeDo will always run without interruption, without errors or without data loss. WeDo may be paused for maintenance, bug fixes or incidents beyond our control. We may add, change or remove features. If we discontinue the whole service, we will give at least 30 days' notice through the app or by email.

9.4. To keep using WeDo, you may sometimes need to update the app to a new version.

9.5. Subscriptions through the App Store. In the iPhone app you can buy Personal Pro or Team Growth as an auto-renewable subscription through the App Store. Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically each period (monthly or yearly) at the price shown at purchase (Apple notifies you and asks for your consent before any price increase), unless you turn off auto-renewal at least 24 hours before the current period ends. You manage and cancel subscriptions in Settings → [your name] → Subscriptions on your iPhone. Refunds for App Store purchases are handled by Apple under Apple's policies; WeDo does not refund in Apple's place. A plan bought through the App Store works in both the app and the WeDo website for the same account.

10. WeDo's intellectual property

10.1. The WeDo name, logo, interface, source code and documentation belong to us or to our licensors. These Terms do not transfer those rights to you.

10.2. We grant you the right to use the WeDo app for personal purposes, under these Terms. This right is limited, non-exclusive, non-transferable and revocable. If you download WeDo from the App Store, the scope of the right is also subject to Article 16.

10.3. You may not copy, modify, distribute, sell or lease the app, and may not reverse engineer the source code, unless the law allows it.

10.4. If you send WeDo feedback or ideas, we may use that feedback to improve WeDo without paying you or owing you any obligation.

10.5. If you believe Content on WeDo infringes your rights, email wedosupport6886@gmail.com. We will handle it as a report under Article 6.

11. Termination

11.1. You can stop using WeDo at any time. To delete your account, go to Account → Delete account ("Tài khoản → Xoá tài khoản") in the app, or follow the instructions at https://wedofpt.com.vn/xoa-tai-khoan.html. If you are the owner of a workspace that still has other members, you must transfer ownership before deleting. If you have ever signed in with Apple, deleting in the app also revokes WeDo's Sign in with Apple. Data after deletion is handled under the Privacy Policy.

11.2. We may suspend or terminate your account, and remove your Content, if:

  1. you violate these Terms, especially Article 5;
  2. a competent state authority requires it;
  3. it is necessary to protect other users, WeDo or third parties.

For serious violations, we act immediately without prior notice. For minor violations, we may warn you first.

11.3. A person whose account has been terminated for a violation may not create a new account.

11.4. If you believe we made a mistake, email wedosupport6886@gmail.com within 30 days of the suspension. We will review again and reply to you.

11.5. Articles 4.5, 10, 12, 13, 14, 15 and 16 remain in effect after an account is terminated.

12. No warranty

12.1. To the extent the law allows, WeDo is provided "as is" and "as available". We do not guarantee that WeDo will meet all your needs, that AI output is correct, or that Content posted by other users is correct or appropriate.

12.2. We are not responsible for Content posted by other users. We still act on violating Content when it is reported, under Article 6.

12.3. This does not remove the rights that Vietnamese consumer protection law gives you.

13. Limitation of liability

13.1. To the extent the law allows, we are not liable for indirect damages, such as lost profits, lost data, lost study opportunities, or effects on grades, arising from your use of, or inability to use, WeDo.

13.2. To the extent the law allows, our total liability to you will not exceed the greater of: (a) the amount you paid to WeDo in the 12 months before the event; and (b) VND 500,000.

13.3. Article 13 does not exclude our liability in cases where the law does not allow it to be excluded, such as our intentional fault.

14. Your responsibility for violations

If you violate these Terms or the law and that causes damage to us or to others, you are responsible for compensation under Vietnamese law.

15. Governing law and dispute resolution

15.1. These Terms are governed by the laws of Vietnam.

15.2. If a dispute arises, first contact us by email at wedosupport6886@gmail.com to negotiate. If it cannot be resolved by negotiation after 30 days, each party has the right to bring the dispute before the competent People's Court of Vietnam.

16. Additional terms when you download WeDo from Apple's App Store

Article 16 applies when you download the WeDo app from the App Store. For an app downloaded from the App Store, Apple's standard Licensed Application End User License Agreement (at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies between you and the provider of WeDo, together with these Terms. If Article 16 differs from the rest of these Terms, Article 16 takes precedence for an app downloaded from the App Store.

16.1. Acknowledgement. These Terms are an agreement between you and the provider of WeDo named in Article 1.2, not with Apple Inc. ("Apple"). The provider of WeDo, not Apple, is solely responsible for the WeDo app and its content. These Terms do not set any usage rule that conflicts with the Apple Media Services Terms and Conditions as of the date these Terms take effect.

16.2. Scope of license. You are granted a non-transferable license to use the WeDo app on Apple-branded devices that you own or control, in accordance with the Usage Rules in the Apple Media Services Terms and Conditions. Exception: other accounts associated with the purchaser through Family Sharing or volume purchasing may also access and use the app.

16.3. Maintenance and support. The provider of WeDo is solely responsible for providing maintenance and support for the app, as specified in these Terms or as required by law. You and the provider of WeDo acknowledge that Apple has no obligation whatsoever to provide any maintenance or support services for the app.

16.4. Warranty. The provider of WeDo is solely responsible for any warranties for the app, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any; the WeDo app is free to download). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of the provider of WeDo.

16.5. Product claims. The provider of WeDo, not Apple, is responsible for addressing any claims by you or by a third party relating to the app or to your possession and use of the app, including but not limited to: (i) product liability claims; (ii) claims that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. These Terms do not limit the provider of WeDo's liability to you beyond what the law allows.

16.6. Intellectual property rights. If a third party claims that the app, or your possession and use of the app, infringes that party's intellectual property rights, the provider of WeDo, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.

16.7. Legal compliance. You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.8. Developer name and contact information. Any questions, complaints or claims about the app should be directed to: Lê Hữu Đại, by email at wedosupport6886@gmail.com.

16.9. Third-party terms. When using the app, you must comply with the agreements that apply between you and third parties, for example your mobile data service agreement with your carrier.

16.10. Third-party beneficiary. You and the provider of WeDo acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Changes to these Terms

17.1. We may amend these Terms. Each time we do, we update the date at the top of the page.

17.2. For major changes, we notify you in the app or by email before they apply, and may ask you to agree again. If you do not agree, you can stop using WeDo and delete your account under Article 11.1.

17.3. For minor changes, such as rewording or updating contact information, your continued use of WeDo means you agree to the new version.

18. General terms

18.1. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the use of WeDo, in addition to Apple's license agreement referred to in Article 16 when you download the app from the App Store.

18.2. If any part of these Terms is held invalid, the remaining parts stay in effect.

18.3. Our not yet enforcing a right does not mean we waive that right.

18.4. We may assign these Terms to an organization that takes over running WeDo, for example a company we set up. If so, we will tell you. You may not transfer your rights and obligations under these Terms to anyone else.

18.5. Language. These Terms are published in Vietnamese and in English, and both versions have equal effect. If the two versions conflict, the Vietnamese version prevails. If there is a translation into any other language, the Vietnamese version also prevails.
